Massachusetts Registry of Motor Vehicles Law

Massachusetts Registry of Motor Vehicles License Suspensions

The Massachusetts Registry of Motor Vehicles has the power to suspend your license for a variety of reasons. Some suspensions are mandatory and others are discretionary. Three, five, or seven surchargeable offenses within certain times the Massachusetts Registry of Motor Vehicles, will lead to a mandatory suspension. 

Three Speeding Tickets within one year the RMV must suspend your license for 30 Days. Five Surchargeables, any combination of five surchargeable offenses (tickets or accidents) within three years, the RMV requires you complete a remedial drivers course. Seven Surchargeables, any combination of seven surchargeable events, (tickets and accidents) the RMV must suspend your license for 60 DAYS  and requires completion of a remedial drivers course.

Discetionary Suspensions, allow the registry to suspend your liscense because of something that they believe. Discretionary suspensions are Immediate threat. Here, the Massachusetts Registry of Motor Vehicles may suspend a person's right to drive indefinitely if the DMV believes that the person's continues operation may endanger the safety of the public.

The Massachusetts Registry of Motor Vehicles may also suspend someone's right to  drive because of Improper Operation. Here, the registry may suspend the person's right to drive for 30 DAYS because of an improper operation of a motor vehicle, or indefinitely where a medical or mental condition exists.

Massachusetts Registy of Motor Vehicles Appeals

If the Massachusetts Registry of Motor Vehicles has, or is planning to suspend your license Attorney Patrick Donovan may be able to help. The RMV employs hearings officers to review your case. After a hearing with a RMV hearing officer if the driver is not satisfied with the decision, the driver can appeal to the Board of Appeals. The Board of Appeals is a three person board, independent of the Massachusetts Registry of Motor Viehicles. This appeal requires a non-refundable filing fee. You have a right have an attorney respresent you with both thhe RMV hearings officer or before the Board of Appeals.
