Diane Marie Hathaway, who once served as a State Supreme Court Justice in Michigan has been sentenced to one year in jail for bank fraud, Hathaway, 59, has retired from the bench. The former judge has been ordered to serve one year in jail and two years of probation. In addition to the federal prison sentence Hathaway must also pay restitution.
The former justice pled guilty to bank fraud where she transferred ownership of her Florida home so that her home in Michigan could be approved for a short sale. Once her short sale was approved and completed, her Florida home was returned to her. Ironically she qualified for a short sale regardless of her second home.
Hathaway will have to repay over $90,000 in restitution to the bank once she is released from prison.
