The Boston Globe has reported that Judge Raymond Dougan the presiding judge of the Boston Municipal Court is now facing a new ethics violation investigation by the Judicial Conduct Commission. Dougan is being investigated for receiving over $85,000 worth of free legal services.
Dougan was previously investigated for being unfairly favorable to people charged with crimes. Dougan prevailed in that procedure. During that investigation Dougan was represented by Attorney Michael Keating. Although the Commission on Judicial Conduct investigations are confidential the Boston Globe has reported that Dougan has been heard complaining of the new investigation
Massachusetts law forbids judges from getting any free legal representation in any ethics violation hearing. The rule is designed to avoid the appearance of a conflict of interest. All judge’s previously investigated have paid their attorney fees in full.
If the Dougan agrees that there is an ethics violation his punishment may include a private reprimand, public reprimand or voluntary retirement. If Dougan does not agree the Massachusetts Supreme Judicial Court would appoint a judge to determine if there is a violation and issue the penalty.
Dougan cannot be removed from the bench yet he could be fined and ordered to repay the legal bill.
