A woman from Batavia, NY a small town near Buffalo, is being sent to jail for 5 years for punching a Walmart greeter. Ms. Jaccquetta Simmons, 27, was convicted by a jury for punching the greeter, 70 year old Grace Suozzi, on Christmas Eve. Jurors watched a store surveillance video that showed Simmons punch Suozzi in the face after Simmons was asked to show her receipt.
Simmons was convicted of second degree felony assault She had been facing a seven year prison sentence had she been convicted of New York’s “Granny Law” where it is a felony to intentionally injure a person over 65 or if the defendant is ten years or younger than the victim.
Like New York State the penalties for assaulting a person over 65 are enhanced in Massachusetts.
