What is the Fake ID law in Massachusetts?
Massachusetts Law 138 section 34B makes having, using or making a false identification card illegal in Massachusetts.
What does the Massachusetts Fake Identification law say?
To prove one guilty of possessing a false identification in Massachusetts the Assistant District Attorney is required to prove the following:
1) did transfer, alter or deface a liquor purchase identification card or motor vehicle license; or
2) did make, use, carry, sell or
3) distribute a false liquor purchase identification card or motor vehicle license; or
4) did use the liquor purchase identification card or motor vehicle license of another; or
5) did furnish false information in obtaining such a liquor purchase identification card or motor vehicle license.
What is the penalty for a fake ID in Massachusetts?
The penalty is imprisonment, not more than 3 months or a fine of not more than $200. Also, a clerk magistrate must report a conviction to the Massachusetts RMV will revoke the person’s license for one year.
Can I lose my license even if my case is dismissed?
M.G.L.c.90,§22(e) allows the RMV to suspend your license or right to operate in Massachusetts for at least six months. A conviction is not required. If you are convicted, your license will be suspended for one year.
