A juvenile court judge in western Massachusetts ordered an 11 year old boy to get a jog so that he can pay restitution. The case went to the Appeals Courts and the court agreed.
The boy was found delinquent (juvenile equivalent of guilty) stayed for one year upon the condition that he pay $1000 to the victims of his vandalism. The boy had spray painted his neighbors newly sided home with red spray paint. After the one year the boy had not paid a cent to the victim. The judge then held a hearing and extended the boys probation for 4 years and ordered that he get a job.
The lawyer appealed arguing that 12 years old is too young for a child to get a job. The layer pointed to the fact that work permits issued by the state are only issued for limited purposes. The lawyer also argued that the child may be in danger of breaking the law in looking for work.
The Massachusetts Appeals Court disagreed and stated that child could look for work in his own neighborhood. The Court stated that the boy could do errands and mow lawns or deliver newspaper. The lawyer intends to appeal to the Massachusetts Supreme Judicial Court.
