Republican United States Senator Michael Crapo was arrested early Sunday morning in Alexandria, Virginia and charged with dui. The Senator was arrested after an Alexandria Virginia police officer pulled him over for failing to stop for a red light.
Senator Crapo performed some field sobriety tests and failed according to the police officer. Sen. Crapo took a breathalyzer test and blew a .11 over the state limit of .08. He is scheduled to appear in a Virginia criminal court on January 4, 2013.
If Senator Crapo was arrested in Massachusetts he should not have taken a breathalyzer or performed field tests. I don’t know what the rules of evidence are in Virginia regarding the admissibility of the breathalyzer result in Massachusetts one cannot even mention a refusal.
Hopefully the Senator will be treated like every other first time offender.
