Assault and Battery Dangerous Weapon Causing Serious Bodily Injury in MA

May 9, 2023 by Patrick Donovan

Assault and battery with a dangerous weapon causing serious bodily injury is a serious crime in the state of Massachusetts. This crime is punishable by up to 10 years in prison and/or a fine of up to $10,000.

In Massachusetts, assault and battery with a dangerous weapon causing serious bodily injury is defined as an intentional act of physical force or violence against another person, with the use of a dangerous weapon, resulting in serious bodily injury. Serious bodily injury is defined as an injury that creates a substantial risk of death, or causes serious disfigurement, serious impairment of health, or serious loss or impairment of the function of any bodily organ.

In order to be convicted of this crime, the prosecution must prove beyond a reasonable doubt that the defendant intended to commit the act of violence, that the defendant used a dangerous weapon, and that the act resulted in serious bodily injury.

A dangerous weapon is defined as any object that is capable of causing serious bodily injury or death. This includes firearms, knives, clubs, and other objects that can be used to cause serious harm.

If you are charged with assault and battery with a dangerous weapon causing serious bodily injury, it is important to seek legal advice from an experienced criminal defense attorney. Massachusetts Criminal Attorney is a former assistant district attorney. Attorney Donovan uses that experience to get the best possible outcome.
