Recent Orleans District Court Victories
Possession of Class B Drug – Client went to a club and unfortunately used a party drug that is classified as a Class B drug. Client had a very bad reaction to the drug and began to lose consciousness. His friends brought him outside. Once outside, they were stopped by a seasonal police officer. The officer searched the client and found drugs on him. Client was charged with possession of a Class B drug in the Orleans District Court. Attorney Donovan filed a successful motion stating the law does not allow the police to charge someone with drug possession who is having a medical episode. The case was dismissed prior to arraignment. The client still has an absolute clean record.
Operating Under the Influence of Alcohol- Client struck a telephone pole, substantially damaging the pole. Police arrived on the scene. The officer noticed the client had slurred speech and glassy eyes. The client admitted to the police officer that she had just drank wine. The client was unsteady on her feet. Also, client told the officer she lost count of how much she had to drink. The officer arrested the client and charged her with Operating Under the Influence of Alcohol. On the day of trial, the prosecutor dismissed the criminal charge. Case DISMISSED.
