Recent Orleans District Court Victories
Possession of Class B Drug – The client went to a club and unfortunately used a party drug that is classified as a Class B drug. Then, the Client had a very bad reaction to the drug. He began to lose consciousness. Finally, his friends brought him outside. At that time, a seasonal Provincetown police officer stopped them outside. There, the officer searched the client. And, he found drugs. Then, the client was charged for possession of a Class B drug in the Orleans District Court. Attorney Donovan filed a successful motion stating the law does not allow the police to charge someone with drug possession who is having a medical episode. Ultimately, the case was dismissed prior to arraignment. The client still has an absolutely clean record.
Operating Under the Influence of Alcohol- The client struck a telephone pole, substantially damaging the pole. Then the Police arrived on the scene. The officer noticed the client had slurred speech and glassy eyes. Then the client admitted to the police officer that she had just drunk wine. The client was unsteady on her feet. Also, the client told the officer she lost count of how much she had to drink. Finally, the officer arrested the client and charged her with Operating Under the Influence of Alcohol. On the day of trial, the prosecutor dismissed the criminal charge. Case DISMISSED.
