Massachusetts General Laws Chapter 266 Section 37.

What is the Penalty for Larceny by Check?

The penalty for felony passing a bad check in Massachusetts is state prison for not more than 5 years or jail not more than 2 years and not more than a $25,000 fine. A felony conviction also requires submission into the DNA database and a reportable felony conviction. The penalty for a misdemeanor larceny by check in Massachusetts is jail for not more than 1 year; or not more than a $300 fine.

Are there any defenses to Larceny by Check?

Yes,  there are defenses to larceny by check charged. The two most common defense is that there was never any intent to defraud and that person did not know there was not enough money in the account. Provided you can prove either defense the prosecutor cannot get a conviction.
